Qualification for Application
1. Foreign companies, enterprises or other economic organizations or individuals

Needed Materials
1. Government, administrative department in charge or agency of project registration area submit request to Nanhui Government. (2 original copies)
2. Registration certificate of investors, certificate of legal representatives and credit certification of foreign bank (2 duplicates)
3. Documents of certifying the subject of investment as a notary public by notary organ of host country, and authentication by Chinese Embassy (for Hong Kong, Macau and Taiwan, documents by notary organ are enough.) (2 duplicates)
4. Enterprise Name Approval Notice (2 duplicates)
5. Feasibility study report written by investors, together with listing of imported equipments (1 original copy, 1 duplicate)
6. Contract, constitution signed by authorized representatives of investors (1 original copy, 1 duplicate)
7. Comments of environmental protection department (2 duplicates)
8. List and letter of designation of board chairman, board members of foreign invested enterprises designed by investors (1 original copy, 1 duplicate)
9. Usage permission of address of registration or leasing agreement, certificate of property rights of lessor (2 duplicates)
10. Assessment of state - owned property and confirmation certification
11. Other materials demanded by government

Process
1. Applicants submit needed materials to Shanghai DAKS Science & Technology Development Co., Ltd., and then DAKS forwards these materials to Nanhui Foreign Economic Commission.
2. Nanhui Foreign Economic Commission examines the materials and issues approval for establishing enterprise to enterprises that meet the requirements.
For enterprises that exceed limitation, or belong to limited or special industries, Nanhui Foreign Economic Commission will forward the materials to Shanghai Foreign Economic Commission for examination and approval.
3. Applicants register enterprise’s code by Shanghai enterprise’s code office according to approval, and then get the approval certificate from Nanhui Foreign Economic Commission or Shanghai Foreign Economic Commission.

Notice
1. Approval authority of Nanhui District: Encouraged and allowed category in Kangqiao Industrial Zone with a total investment volume under 30 million USD.
For enterprises that exceed limitation, or belong to limited or special industries, Nanhui Foreign Economic Commission will forward the materials to Shanghai Foreign Economic Commission for examination and approval.
2. Intermediary organs with agent qualification should be consigned to apply for establishing WFOE.
Consigned agency contract should be attached in application materials, not involved in relevant materials or company contract of Chinese party.
3. The amount of subscribed capital of Chinese party can’t exceed 50% of net assets value of enterprise.
4. If there are Chinese materials, correct translated documents should be provided.
